- Congratulations to Michael S. Fernalld!
Congratulations to Michael S. Fernalld from New Jersey, the winner of last month’s book question where he correctly identified a relatively recent case in tort law, California v. Larue, 409 U.S. 109, 93 S.Ct. 390, 34 L.Ed.2d 342 (1972). In this case, U.S. Supreme Court Justice Rehnquist recognized that an allegedly obscene dance, like any other artistic expression, is protected by the First and Fourteenth Amendments. The Court also stated that the Twenty-First Amendment protects the right of states to ban alcoholic beverages and to make reasonable regulations necessary to protect the public against the adverse effects of alcohol.
